1Acceptance of Terms

By accessing or using the Master Pho Challenge website (the "Site") or registering for the contest, you agree to these Terms of Service ("Terms"). If you do not agree, do not use the Site or register.

2Eligibility

To register and use the Site you must provide accurate information. Participants under 18 may enter only with the consent of a parent or legal guardian, who must complete the guardian section and sign the release on the minor's behalf. Additional eligibility requirements may appear in the Official Contest Rules.

3The Contest & Registration

Master Pho ("Master Pho," "we," "us," or "our") owns and operates this Site to register participants for the Pho Challenge. Spots are limited and offered on a first-come basis. Registration is complete only when payment is received and the required release/waiver is signed. We may close registration when capacity is reached or at the stated deadline. Prizes, dates, and details are described on the Site and in the Official Contest Rules and may be subject to change.

4Entry Fee & Refunds

The entry fee is charged at registration through our third-party payment processor (Stripe). Unless stated otherwise in the Official Contest Rules or required by law, entry fees are non-refundable. You are responsible for any fees your bank or card issuer may charge.

5Assumption of Risk & Waiver

Participating in a competitive eating contest involves inherent risks, including but not limited to choking, allergic reactions, illness, and other medical conditions. As part of registration you will sign an electronic Release & Waiver of Liability. That release, once signed, is incorporated into these Terms. By registering you acknowledge these risks and agree to the release.

6Acceptable Use

• Provide accurate information when you register or contact us.
• Use the Site only for lawful purposes and in compliance with applicable laws.
• Do not attempt to disrupt, damage, gain unauthorized access to, scrape, or interfere with the Site.
• Do not submit unlawful, infringing, or harmful content, or impersonate any person or entity.

7Intellectual Property

All content on the Site, including text, graphics, logos, designs, and software, is owned or licensed by Master Pho and protected by intellectual property laws. You may not copy, reproduce, distribute, or modify Site content without our written permission.

8Disclaimers

The Site is provided "as is" and "as available," without warranties of any kind, express or implied. We do not warrant that the Site will be uninterrupted, error-free, or secure, or that information on the Site is complete or current.

9Limitation of Liability

To the fullest extent permitted by law, Master Pho will not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the Site or registration. Nothing in these Terms limits liability that cannot be limited under applicable law.

10Indemnification

You agree to indemnify and hold harmless Master Pho, its affiliates, owners, employees, and agents from any claims, damages, liabilities, costs, or expenses (including reasonable legal fees) arising from your use of the Site, your registration, your violation of these Terms, or your violation of any applicable law or third-party rights.

11Arbitration & Class-Action Waiver

Any dispute, claim, or controversy arising out of or relating to these Terms, the Site, or your registration will be resolved exclusively by binding arbitration in the State of Georgia, administered by the American Arbitration Association under its applicable rules. You waive the right to participate in a class action, class arbitration, or other representative proceeding, and agree that claims may be brought only in an individual capacity.

12Governing Law

These Terms are governed by the laws of the State of Georgia, without regard to conflict-of-law principles. Any disputes not subject to arbitration will be resolved in the state or federal courts located in DeKalb County, Georgia.

13SMS / Text Messaging

Our registration form offers two separate, optional SMS opt-ins: Contest SMS (registration and contest messages) and Marketing SMS (promotional messages). You only receive the types you opt into. Message frequency varies; message and data rates may apply.
